Sikkim: Namchi Court orders probe into physical assault case involving local resident

The Chief Judicial Magistrate's Court in Namchi has ordered an investigation into an alleged physical assault case involving Prerna Thapa, a resident of Tizir, Namchi. The directive, dated December 18, 2024, was issued under Section 115 of the BNS Act, 2023, in terms of Section 174(2) of the BNSS Act, 2023.
According to the complaint, on December 17, 2024, at approximately 7:43 a.m., Ms. Thapa was allegedly assaulted by her neighbors—Anita Gurung, Nim Diki Sherpa, Karuna Rai, Shanti Maya Rai, and others—following a verbal dispute that escalated into physical violence. The incident occurred near her residence, resulting in injuries, including a subconjunctival hemorrhage.
Thapa, 30, lodged a verbal report at Namchi Police Station the same day. She was subsequently referred to District Hospital Namchi for medical examination, where her injuries were classified as simple. However, an ophthalmology consultation was recommended.
Preliminary inquiries revealed that the altercation stemmed from a verbal dispute among the women. All involved parties were summoned to the police station for questioning and underwent medical examinations, which confirmed no significant injuries among them.
A formal investigation was initiated under FIR No. 56/2024, dated December 19, 2024. Notice under Section 35 of the BNSS Act, 2023, has been served to the accused individuals, and witnesses are being examined. One individual has been detained for further questioning.
