The District Magistrate of Gangtok has issued a Prohibitory Order under Section 163 of the Bharatiya Nyaya Sanhita (BNSS), 2023, restricting gatherings around the Sikkim Legislative Assembly complex from March 25 to March 28, 2025. The order comes ahead of the scheduled sitting of the Sikkim Legislative Assembly to ensure smooth proceedings and maintain law and order.
As per the order, assembly of five or more persons, sloganeering, shouting, rioting, protesting, staging dharnas, demonstrations, picketing, postering, wall writing, or any other disruptive activities are strictly prohibited within a 300-meter radius from the outer boundary of the Assembly Secretariat. The restrictions will remain in effect from 8:00 AM on March 25 until the conclusion of the Assembly session, unless withdrawn earlier.
The order highlights the importance of preserving the sanctity and decorum of the Assembly, stating that any such activities could potentially disturb public peace and tranquillity. The District Magistrate noted that the circumstances do not allow for prior individual notices, and thus, the ex-parte order has been enforced.
However, the order does not apply to law enforcement agencies, including Magistrates, Police Personnel, Army, CRPF, and other Para-Military Forces, who are legally engaged in maintaining law and order.
